The short version

Plain English, then the formal wording below. If the two ever disagree, the formal wording is what counts — but we have tried hard to make them say the same thing.

1. Who these terms are between

These terms are an agreement between you and Qrakr Inc. ("qrakr", "we", "us"), a corporation incorporated federally in Canada and based in Nova Scotia.

They apply to you whether you hold an account, scan a tag, or just browse the site.

By using qrakr, you accept these terms. If you do not accept them, do not use qrakr.

2. Who may use qrakr

You must be at least 16 years old to hold an account. If you are creating an account on behalf of a business, you confirm you are allowed to bind that business.

You may create one account per person. Keep your sign-in secure — anything done through your account is treated as done by you.

3. What qrakr actually is — and what it is not

qrakr is a messaging service. You attach a code to your belongings. If someone finds one and scans it, they land on a page and can send you a message. We deliver that message without either of you seeing the other's real contact details.

What we do not do, and never promise:

If you arrange to meet someone to collect your property, that is entirely between the two of you. Meet in a public place. Consider involving local police. We are not part of that arrangement and take no responsibility for it.

You keep ownership of everything you put into qrakr — item photos, descriptions, messages.

By uploading it, you give us permission to store it, and to display it on your public found page to whoever scans that tag. That permission is limited to running the service, and it ends when you delete the content, except for backups that age out on our normal schedule.

You promise that:

Please do not put personal details on a public found page. It is visible to anyone who scans that tag. Your first name is usually enough.

6. Things you must not do

We may suspend or terminate any account, and disable any tag, immediately and without notice, if we reasonably believe it is being used for any of the above — or if we need to in order to protect someone's safety.

7. Reporting abuse

If someone uses qrakr to harass or endanger you, email [email protected]. We will act as fast as we reasonably can, and we will cooperate with law enforcement where we are required or where safety demands it.

8. Paid plans

What you get: the features listed on our pricing page for the plan you choose. Plan limits are published there and are what we actually enforce.

Billing: subscriptions renew automatically, monthly or annually, on the same date, until you cancel. Payment is processed by Stripe. Prices are in Canadian dollars (CAD) and exclude tax unless stated.

Cancelling: you can cancel any time from your account settings, in no more steps than it took to subscribe. Cancellation takes effect at the end of the period you have already paid for — you keep your paid features until then.

What happens after you cancel: your tags keep working. Features that require a paid plan stop. We do not switch off tags you have already printed and put on your belongings.

Refunds: we do not refund partial periods — if you cancel mid-month, you keep the service until the period ends rather than getting money back. But if you were charged and did not mean to be, tell us within 30 days and we will refund it. We will not argue with you about it.

Price changes: we will give you at least 30 days' notice by email before a price change affects you. You can cancel before it takes effect.

8.1 Sticker packs

We also sell printed qrakr stickers from our website. This section covers those; the rest of section 8 is about subscriptions.

What you are buying: a pack of pre-printed, weatherproof stickers, each carrying its own qrakr code and a PIN printed beside it on the sheet. A sticker becomes yours when you set it up in your account with that PIN. Until then it is blank stock; anyone holding the sheet with the PIN can set it up, so treat the sheet like a key. Stickers you buy and set up do not count against your plan's tag limit.

Price and payment: the price shown on the product page is the total you pay, in Canadian dollars, and includes shipping within Canada. Payment is processed by Stripe on a Stripe-hosted page; we never see your card details.

Where and how we ship: Canada only. We mail every order by Canada Post lettermail within 5 business days of receiving it. Lettermail has no tracking, so we cannot tell you where a pack is once it is posted. Delivery times are Canada Post's, not ours.

Lost or damaged in the mail: if a pack has not arrived 10 business days after we mailed it, or arrives damaged, email [email protected] and we will send a replacement once, at no charge, no argument. We do not replace a pack that has been set up.

No refunds or returns on sticker packs. The exception is the same one as for subscriptions: if you were charged and did not mean to be, tell us within 30 days and we will refund it.

Sticker packs are not a lost-and-found service. Section 3 applies to them exactly as it applies to the rest of qrakr: a sticker gives a finder a way to contact you. It does not find, recover, insure or guarantee the return of anything.

9. Availability

We work hard to keep qrakr running, particularly the scan page, because that is the part that matters when someone has your property in their hands. But we do not promise uninterrupted service. We may need to take things down for maintenance, and things outside our control will sometimes break.

We provide qrakr "as is", without warranties of any kind, to the fullest extent the law allows.

10. Limits on what we owe you

To the fullest extent permitted by law:

Some places do not allow these limits. Where that is true, they apply only as far as the law permits, and nothing here limits liability for death, personal injury caused by our negligence, or fraud.

11. If we cause you to be sued

If you break these terms or the law and that causes someone to bring a claim against us, you agree to cover our reasonable costs of dealing with it.

12. Changes to these terms

We may update these terms. If a change is significant, we will email account holders at least 30 days beforehand. Continuing to use qrakr after a change takes effect means you accept it. If you do not, cancel and stop using the service.

13. Ending the agreement

You can close your account any time, from settings.

We can suspend or close your account if you break these terms, if we are required to by law, or if we stop operating qrakr. If we shut the service down, we will give you at least 90 days' notice and a way to export your data — you have physical tags in the world that point at us, and disappearing without warning would not be acceptable.

14. Which law applies

These terms are governed by the laws of Nova Scotia, Canada and the federal laws of Canada that apply there. Disputes go to the courts of Nova Scotia.

If you are a consumer, this does not take away any right you have to bring a claim where you live, or to rely on the consumer protection laws of your own province, state or country.
